Legal Information and Acceptance of Conditions

These Terms and Conditions ("T&C") govern the access to and use of the website www.mallorcaunlocked.com (hereinafter, the "Website"), as well as the purchase of the services offered through it.

In accordance with the information obligation established in Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI), the identification details of the Website owner are provided below:

• Activity: Intermediation in the sale of tickets and services for events and tourist activities.

The use of the Website, which includes simple browsing, accessing content, or purchasing any service, confers the status of "User" and implies the full, explicit, and unreserved acceptance of all provisions contained in these T&C, in the version published at the time of access. Failure to accept these T&C will prevent the use of the Website and its services. Acceptance is a fundamental prerequisite for the validity of any transaction and for the legal protection of both parties, in line with Spanish regulations aimed at generating trust and transparency in e-commerce.

The Owner reserves the right to unilaterally modify, at any time and without prior notice, the presentation, configuration, and content of the Website, as well as these T&C. The new conditions will be applicable from the moment of their publication on the Website. It is the User's responsibility to periodically consult the T&C to be aware of any changes.

1. Definitions

To ensure maximum clarity and prevent ambiguity in the interpretation of this contract, the following terms shall have the meaning specified below:

• Website: The web platform accessible through the domain name www.mallorcaunlocked.com and its subdomains, owned and managed by the Owner.

• Owner: as identified in the preamble, acting as a provider of intermediation services through the Website.

• User or Customer: Any natural person, who declares to be of legal age (18 years or older) and to have the necessary legal capacity to contract, who accesses the Website to obtain information and/or purchase the services offered.

• Event Organizer: The third-party natural or legal person (e.g., nightclub, party promoter, transport company, tour organizer) who organizes, manages, and assumes final responsibility for the Event for which the Owner acts as an intermediary in the sale of access titles.

• Event: The event, recreational activity, tourist or entertainment service (e.g., nightclub evening, boat party, bus trip, access to a beach club) that takes place on a specific date or during a specific period, promoted and managed by a third-party Organizer.

• Presale Service/Voucher (Model A): The intermediation service provided by the Owner, which consists of researching, selecting, negotiating, and booking an access title for an Event at a guaranteed price. The purchase of this service, through the payment of a Deposit, entitles the holder to an electronic voucher that must be presented to the Event Organizer to gain access, after paying the remaining Balance on-site.

• Ticket (Model B): The full-price access title, purchased through the Website, which gives the User the right to access and participate in a specific Event on a specific date, without the need for additional payments to the Organizer for entry.

• Deposit: The amount, specified during the purchase process, that the User pays to the Owner as consideration for the Presale Service/Voucher. This amount, as detailed in the refund section, is non-refundable in case of cancellation by the User, as it remunerates an intermediation service that has already been completed.

• Balance: The remaining amount of the total price of the Event, which the User, holding a Voucher (Model A), must pay directly to the Event Organizer at the event venue to receive the final service (e.g., entry, wristband with drinks, etc.).

2. Object of the Service and Role of Mallorca Unlocked

The object of the contract between the Owner and the User is the provision of an intermediation service for the purchase of access titles (Vouchers or Tickets) that allow participation in Events organized by third parties.

It is essential to clarify that Mallorca Unlocked is not the organizer of the Events offered on the Website. The Owner acts exclusively as a commercial intermediary (or agent), in the name and on behalf of the respective Event Organizers. The Owner's role is completed with the correct management of the online booking process and the electronic issuance and delivery of the access title purchased by the User.

Consequently:

1. The contract for the final service provision (i.e., the actual execution of the Event, with all its characteristics and conditions) is concluded directly between the User and the Event Organizer at the time the purchase is completed on the Website.

2. All conditions relating to the Event, including access rules, security, schedules, artist line-ups, service quality, and any changes or cancellations, are established and managed exclusively by the Event Organizer.

3. The added value offered by Mallorca Unlocked consists of selecting and aggregating the best entertainment offers in Majorca, negotiating advantageous conditions (such as locked prices), and providing the User with a simple and secure booking platform.

3. Purchase Procedure and Conclusion of the Contract

The purchase of services through the Website is a guided process that consists of the following steps:

1. Service Selection: The User selects the Event of interest.

2. Data Entry: The User must provide the necessary personal data (name, surname, email). It is the User's responsibility to ensure the accuracy of this data.

3. Order Summary: Before payment, the Website will display a detailed order summary, clearly indicating the service, the price breakdown (Deposit and Balance for Model A, or total price for Model B), and the total amount to be paid.

4. Acceptance of Terms and Conditions: The User must accept these T&C by ticking a specific checkbox, which will not be pre-ticked.

5. Payment: By clicking the confirmation button, the User will be redirected to the secure platform of our payment service provider (e.g., Stripe, PayPal) to complete the transaction.

6. Order Confirmation: The purchase contract is concluded when the User receives an "Order Confirmation" email, which will contain a summary of the purchase and the electronic Voucher or Ticket.

4. Prices and Payments

Prices are expressed in Euros (€) and include the current Spanish VAT. The total price is always clearly indicated before final confirmation. Mallorca Unlocked does not store full credit card details; transactions are handled by secure, certified third-party payment gateways.

5. Cancellation, Right of Withdrawal, and Refund Policy

This section is of fundamental importance and defines the rights and obligations of the parties in case of cancellation. The User is invited to read it carefully before purchasing.

5.1. Exclusion of the Right of Withdrawal IMPORTANT INFORMATION ON THE RIGHT OF WITHDRAWAL: In accordance with Article 103(l) of the Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users (transposing Article 16(l) of the European Directive 2011/83/EU), the right of withdrawal (commonly known as the 14-day "cooling-off period") is legally EXCLUDED for contracts related to the provision of leisure activities, if such contracts provide for a specific date or period of performance.

All services sold on www.mallorcaunlocked.com fall into this legal category. Consequently, once the purchase is confirmed, the User does not have the right to withdraw from the contract and request a refund for a change of mind.

5.2. Cancellation and Refund Policy The possibility of obtaining a refund depends exclusively on the cause of the cancellation.

• 5.2.1. Cancellation by the User (Waiver or No-Show): If the User decides not to attend the Event, they will not be entitled to any refund, neither for the Deposit (Model A) nor for the full Ticket (Model B).

• 5.2.2. Cancellation or Substantial Modification by the Event Organizer: If the Organizer officially cancels an Event, the User is entitled to a refund of the amounts paid. The management of the refund process is the exclusive responsibility of the Organizer, but Mallorca Unlocked will act as a facilitator, providing assistance and information.

• 5.2.3. Right of Admission and Denied Entry Due to User's Fault: The Event Organizer reserves the right of admission. Entry may be legally denied, without right to a refund, to anyone who does not meet the minimum age requirement (usually 18), cannot present a valid ID, is intoxicated, or does not comply with the venue's dress code.

6. Obligations and Responsibilities of the User

By purchasing a service, the User agrees to provide correct data, safeguard their access title (Voucher/Ticket), not resell it for commercial purposes, and comply with all requirements for access to the Event (ID, minimum age, dress code, etc.).

7. Limitation of Liability of Mallorca Unlocked

As an intermediary, the Owner's liability is strictly limited to the correct execution of its contractual obligations, which consist of managing the booking platform and issuing a valid access title. The Owner is not responsible for any issues related to the actual organization and execution of the Event, which are the exclusive responsibility of the Event Organizer.

8. Applicable Law and Competent Jurisdiction

These T&C are governed by Spanish law. For any dispute, if the User is a consumer, the court of their place of residence will be competent. In all other cases, the parties submit to the exclusive jurisdiction of the Courts of Palma de Mallorca, Spain. Users are also informed of their right to use the EU's online dispute resolution platform (ODR platform).
